Who's side are you taking in the suing of Samsung by Apple and why (more info, pls don't report)?

Apple is suing samsung because their phone designs are much like that of the iPhone (see picture in link). I take Samsung. This is stupid. Can't you only sue them if they are FLAT OUT copying the design? Plus, it's stalling the release of Samsung Galaxy s2, which my bro will buy so I can get his better cell. Samsung. Apple are being awfully petty and I hope some of the other companies they are picking fights with intend to sue them back on what ever patents they can.
